These Terms & Conditions (“Terms”) govern your access to and use of the NautiSignal mobile application and related services (the “Service”) provided by NautiSignal, LLC (“NautiSignal,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be able to form a binding contract to use the Service. You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account.
2. Description of the Service
NautiSignal provides a mobile application and related services for operating offshore fishing tournaments. As part of the Service, we use SMS text messaging for two purposes: to deliver account verification codes (one-time setup and sign-in codes that secure your account), and to send tournament operations messages — such as catch confirmations and schedule updates — for tournaments you participate in. We do not send promotional or marketing text messages. The SMS program is limited to these transactional messages and is never used for marketing, promotions, sweepstakes, raffles, giveaways, contests, or sponsorship, and never carries third-party content; audience-engagement features such as raffles, giveaways, and sponsor moments are part of NautiSignal’s live audio broadcast, not text messaging.
3. SMS Messaging Terms
NautiSignal sends SMS text messages only to users who have given express, standalone consent. When you provide a mobile phone number on the NautiSignal captain setup form, you must check a separate, unchecked-by-default box agreeing to receive text messages from NautiSignal. Creating an account or agreeing to these Terms does not by itself enroll you in SMS messaging. Message types: Account verification codes (one-time setup and sign-in codes) and tournament operations messages such as catch confirmations and schedule updates.
Message frequency: Varies based on your activity (for example, how often you sign in and how many catches your vessel reports during a tournament).
Cost: Message and data rates may apply. Consult your mobile carrier for details.
Opt-out & help: Reply STOP to any message to opt out of SMS at any time. Reply HELP for assistance, or contact info@nautisignal.com.
Carriers are not liable for delayed or undelivered messages. Your consent to receive SMS is not a condition of any purchase.
We do not sell or share your mobile phone number or SMS consent with third parties or affiliates for their marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
4. Acceptable Use
You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with its operation, using it for unlawful purposes, or violating the rights of others.
5. Intellectual Property
The Service, including its software, content, and trademarks, is owned by NautiSignal or its licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
6. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
7. Limitation of Liability
To the fullest extent permitted by law, NautiSignal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service.
8. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
