These Terms & Conditions (“Terms”) govern your access to and use of the NautiSignal mobile application and related services (the “Service”) provided by NautiSignal (“NautiSignal,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be able to form a binding contract to use the Service. You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account.

2. Description of the Service

NautiSignal provides a mobile application and related account services. As part of the Service, we use SMS text messaging to deliver one-time passcodes (OTPs) and identity- or login-verification codes to help secure your account.

3. SMS Messaging Terms

NautiSignal sends SMS text messages only to users who have given express, standalone consent. When you provide a mobile phone number on the NautiSignal captain setup form, you must check a separate, unchecked-by-default box agreeing to receive text messages from NautiSignal. Creating an account or agreeing to these Terms does not by itself enroll you in SMS messaging. The full messaging program terms, including the exact consent wording shown at opt-in, are published in our SMS Policy.

Message types: One-time passcodes and identity/login verification messages.

Message frequency: Varies based on your activity (for example, each time you log in or verify your account).

Cost: Message and data rates may apply. Consult your mobile carrier for details.

Opt-out & help: Reply STOP to any message to opt out of SMS at any time. Reply HELP for assistance, or contact support@nautisignal.com.

Carriers are not liable for delayed or undelivered messages. Your consent to receive SMS is not a condition of any purchase.

We do not sell or share your mobile phone number or SMS consent with third parties or affiliates for their marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

4. Acceptable Use

You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with its operation, using it for unlawful purposes, or violating the rights of others.

5. Intellectual Property

The Service, including its software, content, and trademarks, is owned by NautiSignal or its licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, NautiSignal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service.

8. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
